These Terms of Service (the “Agreement”) set forth the rules and conditions for using the services provided by ArtistPush OÜ, a private limited company registered in Estonia.

References to “Artist Push”, “we”, “our”, or “us” refer to ArtistPush OÜ. References to “you” or “your” refer to the customer or user of our website and services.

By accessing or using our website artistpush.me and any related services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase any services.

1. General Use

1. Our services are designed solely for legitimate music promotion and marketing purposes.

2. You agree not to use our services for any illegal, abusive, or harmful activities, including but not limited to the distribution of explicit, hateful, or infringing content.

3. Artist Push provides digital marketing and audience engagement services, but we do not guarantee specific results such as follower numbers, plays, or engagement stability. Performance may vary based on multiple factors outside our control.

4. You use our services at your own risk. We are not liable for any damages or losses arising from your use of the services.

5. If there are discrepancies between these Terms and any other content on our website, these Terms prevail.

2. Eligibility and Account Responsibilities

1. You must be at least 18 years old or the age of majority in your jurisdiction to use our services.

2. When creating an account or placing an order, you agree to provide accurate and up-to-date information.

3. You are solely responsible for maintaining the confidentiality of your login credentials and any actions taken through your account.

4. Artist Push reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or use false information.

3. Payments

1. Prices and accepted payment methods are clearly stated on our website.

2. All payments are final once the order process has started. Please ensure you understand the nature of your purchase before completing the transaction.

3. Artist Push reserves the right to update pricing or payment terms at any time. Such updates do not affect already processed or completed orders.

4. Fraudulent disputes or chargebacks are strictly prohibited and may result in account termination, IP blocking, and potential legal action.

5. Although we use trusted payment processors, we cannot guarantee the absolute security of online transactions.

4. Service Delivery

1. We always aim to deliver services within the timeframe stated on the product page, but occasional delays may occur due to platform algorithms or technical limitations.

2. If your order is delayed, please contact our support team — we will review and resolve the issue as soon as possible.

3. Changing your username, artist name, profile URL, or deleting your account during an active campaign may disrupt or void delivery, and Artist Push cannot be held responsible in such cases.

4. Using other promotional providers simultaneously with our services may interfere with performance. We are not responsible for overlapping campaigns run with third parties.

5. Prohibited Activities

You agree not to:

• Use our services to promote content that is illegal, hateful, misleading, or violates third-party rights.

• Manipulate metrics dishonestly or attempt to interfere with the performance of our platform.

• Engage in fraudulent activity, chargeback abuse, or unauthorized transactions.

6. Limitation of Liability

1. To the fullest extent permitted by law, Artist Push OÜ shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, data, goodwill, or reputation.

2. Our total liability, if any, shall not exceed the amount paid by you for the service in the 30 days preceding the claim.

3. We are not responsible for issues caused by third-party platforms such as Spotify, YouTube, or Apple Music, including removal of tracks, accounts, or statistics.

4. Artist Push OÜ shall not be liable for performance failures due to circumstances beyond our control (force majeure), such as internet outages, strikes, regulatory changes, war, or acts of nature.

7. Intellectual Property

1. All content on our website, including text, graphics, code, logos, and other materials, is the exclusive property of ArtistPush OÜ and is protected by Estonian and international intellectual property laws.

2. You may not reproduce, distribute, or use any material from our website for commercial purposes without prior written consent.

8. Data & Privacy

1. Artist Push collects and processes customer data in accordance with applicable EU and Estonian data protection laws (GDPR).

2. We collect only the data necessary to provide and improve our services.

3. Personal data may be shared with trusted third-party service providers solely for operational purposes, under strict confidentiality agreements.

4. You may request data access or deletion in line with applicable laws by contacting our support team.

9. Compliance and Sanctions Policy

1. ArtistPush OÜ strictly complies with all applicable EU, U.S., U.N., and Ukrainian sanctions regulations.

2. We do not provide services to individuals or entities located in, or affiliated with, countries or organizations subject to comprehensive sanctions.

3. Artist Push openly supports Ukraine and condemns the Russian Federation’s military aggression.

4. Orders placed by individuals or entities identified as citizens, residents, or legal persons of the Russian Federation or Belarus may be refused or canceled without refund.

5. Funds from canceled orders may, at our discretion, be redirected to humanitarian or defence support initiatives for Ukraine.

10. Indemnification

You agree to indemnify and hold harmless ArtistPush OÜ, its employees, partners, and affiliates from any claims, damages, or losses arising from:

• Your breach of these Terms;

• Misuse of our services;

• Violation of applicable laws or third-party rights.

11. Governing Law and Dispute Resolution

1. These Terms are governed by the laws of Estonia.

2. Any dispute arising under or in connection with this Agreement shall be resolved exclusively by the courts of Estonia.

3. However, we may seek injunctive relief or other remedies in any jurisdiction where intellectual property or reputational harm occurs.

12. Final Provisions

1. These Terms constitute the entire agreement between you and ArtistPush OÜ.

2. Failure by Artist Push to enforce any provision shall not be considered a waiver of rights.

3. If any clause is deemed invalid or unenforceable, the remaining provisions shall continue in full effect.

4. Artist Push reserves the right to amend these Terms at any time. Updates will be posted on our website and take effect immediately upon publication.
